This work extends theory about entrepreneurship across formal and informal institutional boundaries. While research has identified formal, informal, and renegade economies, we introduce the concept of the controversial economy, defined as the set of legal but illegitimate activities through which actors exploit opportunities. We explain the existence of the controversial economy, its prevalence, and provide examples. We explore how and why entrepreneurs may exploit opportunities in the controversial economy based on individual and opportunity-related attributes. The automatic prediction of court case judgments using Deep Learning and Natural Language Processing is challenged by the variety of norms and regulations, the inherent complexity of the forensic language, and the length of legal judgments. Although state-of-the-art transformer-based architectures and Large Language Models (LLMs) are pre-trained on large-scale datasets, the underlying model reasoning is not transparent to the legal expert. This paper jointly addresses court judgment prediction and explanation by not only predicting the judgment but also providing legal experts (...) with sentence-based explanations. To boost the performance of both tasks we leverage a legal named entity recognition step, which automatically annotates documents with meaningful domain-specific entity tags and masks the corresponding fine-grained descriptions. In such a way, transformer-based architectures and Large Language Models can attend to in-domain entity-related information in the inference process while neglecting irrelevant details. Furthermore, the explainer can boost the relevance of entity-enriched sentences while limiting the diffusion of potentially sensitive information. We also explore the use of in-context learning and lightweight fine-tuning to tailor LLMs to the legal language style and the downstream prediction and explanation tasks. The results obtained on a benchmark dataset from the Indian judicial system show the superior performance of entity-aware approaches to both judgment prediction and explanation. (shrink)

While research has focused on why certain entrepreneurs elect to create innovative solutions to social problems, very little is known about why some social entrepreneurs choose to scale their solutions while others do not. Research on scaling has generally focused on organizational characteristics often overlooking factors at the individual level that may affect scaling decisions. Drawing on the multidimensional construct of moral intensity, we propose a theoretical model of ethical decision making to explain why a social entrepreneur’s perception of moral (...) intensity of the social problem, coupled with their personal desire for control, can significantly influence scaling decisions. Specifically, we propose that higher levels of perceived moral intensity will positively influence the likelihood of scaling through open as opposed to closed modes in order to achieve greater speed and scope of social impact. However, we also propose this effect will be negatively moderated by a social entrepreneur’s higher levels of desire for control. Our model has implications for research and practice at the interface of ethics and social entrepreneurship. (shrink)

In this paper, I offer a systematic account of Kant’s view on ‘phenomenal substance’. Several studies have recently analyzed Kant’s notion of substance. However, I submit that more needs to be said about how this notion is reconceptualized within the critical framework to vindicate a genuine and legitimate sense of substance in the phenomenal realm. More specifically, I show that Kant’s transcendental idealism does not commit him to a rejection of substantiality in phenomena. Rather, Kant isolates a general notion of (...) substance (as ultimate subject) and argues that (i) the relationality of phenomena is compatible with this notion; and that (ii) matter and all its parts are the ultimate subjects of everything existing in space (as what is independently movable in space). I suggest that vindicating a genuine and legitimate notion of phenomenal substance has far-ranging consequences for the interpretation of Kant’s empirical realism. (shrink)

In this article, I maintain that the anti-theoretical spirit which pervades Williams's ethics is close to the Humean project of developing and defending an ethics based on sentiments which has its main focus in the virtues. In particular, I argue that there are similar underlying themes which run through the philosophies of Hume and Williams, such as the view that a correct ethical perspective cannot avoid dealing with a broader theory of human nature; the conviction that this inquiry cannot be (...) developed in abstraction from the contingencies which are distinctive of the lives of flesh-and-blood human beings driven by passions; and the belief that the notion of character plays a key role in identifying and morally evaluating such lives. Finally, Williams' account of the psychological mechanism of shame in explaining character formation bears a strong resemblance to Hume's treatment of the passion of humility. This article sheds light on the relation between care for the soul and the political thought of Jan Patočka. Patočka often sketches a connection between care for the soul and a theory of the state, but he rarely elaborates this. The biographical fact of Patočka’s own political dissidence and his interpretation of care for the soul as a distancing from traditional structures of society have caused many to look at Patočka’s political thought mainly through the lens of political resistance. Such (...) interpretations are definitely warranted, but can overlook the moments in his work that point towards a theory of the state. While these are only indications, this article presents a way to develop these moments. It will do so on the basis of the idea that the theory of the state should not be based directly on care for the soul itself, but on its founding principle of problematicity. The stronger, perhaps more metaphysical, interpretation of problematicity that is argued for here both opens the space of the political and sets strict boundaries to it and as such should be the founding principle of any state that wishes to uphold this space. The Italian philosopher Benedetto Croce (1866-1952) spent most of his life as a private scholar in Naples. His Estetica, which first appeared in 1902, has remained a seminal work not only for aesthetics but also for general linguistics. As the full title indicates, this is not a narrow work dealing with the theory of art and criticism. For Croce intended this to be the first part of his "philosophy of the spirit" and he thus presents a systematic general theory (...) intended to solve all philosophical problems. The work presents an account of the structure of the human mind and shows how art arises naturally from that structure, as well as introducing the influential notion of the organic unity of a work of art. As a result, art is shown to be integral to any life and an essential aspect of what it is to be human. This new translation of the first and most important part of the work (Theory) supersedes the defective translation by D. Ainslie, first published in 1909. It is based on the most recent Italian edition (1990). In his foreword the translator addresses the difficulties in translating certain key words in the Italian original, "scienza", "fantasia", and of course, "estetica" itself. He also furnishes the reader with helpful explanatory annotation. This publication will be of cardinal importance for all those interested in the philosophy of art, the history of criticism, and the history of linguistics. (shrink)

This paper will critically assess Popper’s evolutionary philosophy. There exists a rich literature on the topic with which we have many reservations. We believe that Popper’s evolutionary philosophy should be assessed in light of the intriguing theoretical insights offered, during the last 10 years or so, by the philosophy of biology, evolutionary biology and molecular biology. We will argue that, when analysed in this manner, Popper’s ideas concerning the nature of selection, Lamarckism and the theoretical limits of neo-Darwinism can be (...) appreciated in their full biological and philosophical value. In this essay, I analyse Timaeus’ prescription at 37e3–38b3 on how to use some tensed and tenseless phrases, with particular regard to the verb “be”. I provide an interpretation of (i) what the meaning of the εἴδη (forms or aspects) of time is, and (ii) some epistemological and semantical implications of the tenseless use of “is”. Then, I connect this passage to two famous sections of Timaeus’ proemium, namely the distinction between being and becoming (28a1–4), and the statement that λόγοι (...) are interpreters (ἐξηγῆται) and kin of (συγγενεῖς) what they speak about (29b2–c3). I show that the connection between the two parts of the dialogue is actually quite close and that they illuminate each other. My main interpretive proposal is that the relation between λόγοι and the temporal or atemporal status of their objects is so strict that not only does it affect their epistemic status but also their form. I analyse Theaet. 200e-201c. I hold that this passage provides specific insights into: first, the nature of sensible things and events; second, the nature of knowledge. I show that the text should be taken as an analogy, which means that Plato does not consider eye-witnessing to be a case of knowledge. Finally, I consider the relation between the trial analogy and the dialogue as a whole.

Custom is a complex phenomenon, and one that is hardly given a satisfying account, especially if it is assumed, as many legal positivists do, that law is only produced through acts of will. After examining five main reasons for the complexity of custom, I will consider Uberto Scarpelli’s thesis that customary law can be given an account within legal positivism through a reinterpretation of norm-generating facts as the manifestations of a will. But what kind of will is implied here, and (...) how can the underlying norm be inferred? I will first briefly examine Gaetano Carcaterra’s analysis of abduction as a method to infer norms from behaviors, and then distinguish six different forms of will possibly implied in a behavior which is relevant for the formation of a customary norm. I will finally focus on norm-oriented, or nomotropic will, and especially on nomotrophic will, that is, the will –implied and expressed in the reaction to the violation of a norm– that the infringed norm be valid.
